ACTIVITY WAIVER & RELEASE FORM

Assumption of Risk

I, the undersigned, understand that my participation in Bufaya's ceremonies and retreats involving ancestral medicines (including but not limited to ayahuasca, Kambo, Bufo Alvarius, psilocybin, etc.) involves certain inherent risks. These risks may include, but are not limited to:

  • Physical risks: nausea, vomiting, physical discomfort, changes in blood pressure, allergic reactions, or other unexpected physical effects.

  • Emotional and psychological risks: intense emotional experiences, altered states of consciousness, psychological distress, and possible triggers related to past trauma.

  • Environmental risks: the natural setting where ceremonies and retreats may be held, including risks associated with outdoor locations, insects, animals, uneven terrain, or weather conditions.

I voluntarily choose to participate with full knowledge and understanding of these risks, and I agree to assume all responsibility for any injury, harm, or other consequences that may result from my participation.

Medical Considerations

I acknowledge and affirm that:

  • I am in good physical, emotional, and psychological health, and have been cleared by a healthcare provider if necessary, to participate in ceremonies involving ancestral medicines.

  • I have disclosed all relevant medical information, including any known medical conditions, medications, mental health concerns, or history of substance abuse, in the Bufaya Intake Form.

  • I understand that ancestral medicine ceremonies are not a substitute for professional medical treatment or therapy.

  • I agree to abstain from alcohol, recreational drugs, and any substances contraindicated for the duration of the ceremony or retreat as advised by Bufaya staff and facilitators.

Release of Liability

In consideration of my participation in any ceremony, retreat, or activity hosted by Bufaya, I agree to the following:

  • I hereby release, waive, and discharge Bufaya, its owners, facilitators, employees, contractors, volunteers, agents, and affiliates (collectively, “the Released Parties”) from any and all liability, claims, demands, or actions, whether known or unknown, arising out of my participation in any ceremony or retreat.

  • I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs, including medical expenses, arising from my participation.

  • This waiver applies to any claims resulting from ordinary negligence by the Released Parties, including but not limited to accidents, injuries, emotional or psychological distress, or any other unforeseen consequences arising from participation.

Personal Responsibility

I acknowledge that it is my personal responsibility to:

  • Comply with all instructions: I agree to follow all guidance, instructions, and safety protocols provided by the facilitators and staff of Bufaya during the ceremonies and retreats.

  • Respect the process: I commit to approaching the ceremonies with respect for the ancestral medicines, the facilitators, and other participants.

  • Respect confidentiality: I will respect the privacy and confidentiality of other participants and will not share their experiences outside the group.

Photographic & Video Release

  • I acknowledge and agree that Bufaya may record the ceremonies or retreats through photography or video (with prior consent). I grant permission for my likeness to be used in promotional materials, social media, or other media, unless I explicitly opt out in writing before the start of the retreat or ceremony.

Cancellation Policy

I acknowledge that I have read and understand the Bufaya Cancellation Policy and agree to the terms of no refunds, with the option to transfer credits for future retreats or ceremonies, as outlined in the policy.

Binding Arbitration Clause

I agree that any disputes or claims arising out of this agreement or my participation in the activities provided by Bufaya will be resolved through binding arbitration in accordance with the rules of the Arbitration Clause.

Acknowledgment of Understanding

By signing this Activity Waiver & Release Form, I acknowledge that I have read this document in its entirety, understand its contents, and agree to be bound by its terms. I understand that by signing this form, I am waiving certain legal rights, including the right to sue the Released Parties for any claims, injuries, or damages that may arise out of my participation.
