ARBITRATION CLAUSE
Any dispute, controversy, or claim arising out of or relating to your participation in Bufaya’s ceremonies, retreats, or any services provided by Bufaya, including any disputes regarding the interpretation of this agreement or the rights and obligations of the parties, shall be resolved by binding arbitration in accordance with the following terms:
Governing Arbitration Rules:
The arbitration shall be conducted in accordance with the rules of the [Insert Arbitration Body, e.g., the American Arbitration Association (AAA), JAMS, or any other recognized body], and will follow the expedited procedures where applicable. The arbitrator's decision will be final and binding on both parties.Selection of Arbitrator:
The arbitration shall be presided over by a single arbitrator selected by mutual agreement of the parties. If the parties are unable to agree on an arbitrator, the arbitrator shall be appointed by the governing arbitration body in accordance with its rules.Arbitration Location:
The arbitration will take place in Flint/Michigan/US, unless both parties mutually agree to a different location.Costs and Fees:
Each party shall bear its own costs and expenses, including legal fees, incurred in connection with the arbitration. The costs of the arbitrator and the administration of the arbitration shall be divided equally between the parties, unless otherwise awarded by the arbitrator.Confidentiality:
All proceedings and the decision of the arbitrator shall remain confidential, and neither party shall disclose any information related to the arbitration to any third party without the prior written consent of the other party, except as required by law.Limited Scope of Review:
The arbitrator shall have the authority to grant any relief that would otherwise be available in court, including damages, injunctive relief, and specific performance. However, the arbitrator’s authority is limited to resolving the specific issues in dispute and does not extend to modifying the terms of this agreement or awarding punitive damages, except as provided under applicable law.Waiver of Class Action Rights:
The parties agree that any arbitration shall be conducted on an individual basis only and not as a class action or other representative action. Each party expressly waives any right to file or participate in a class action lawsuit.Governing Law:
The arbitration proceedings and the rights of the parties shall be governed by and construed in accordance with the laws of Michigan/USA, without regard to its conflict of laws principles.Exclusive Remedy:
Arbitration is the exclusive remedy for any claims arising out of or related to your participation in Bufaya’s services, ceremonies, or retreats. By agreeing to this clause, you waive your right to pursue any legal or equitable remedy in a court of law.Judgment on Award:
The judgment of the arbitrator may be entered in any court of competent jurisdiction to enforce the award.
Acknowledgment
By agreeing to Bufaya’s Terms and Conditions, or by signing any related documents, you acknowledge that you have read and understood this arbitration clause and agree to submit any disputes to binding arbitration as outlined above.
